1. Acceptance of Terms
By accessing or using Dial Out ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Dial Out is a customer relationship management (CRM) and outbound dialing platform designed specifically for life insurance agencies. The Service includes lead upload and management, built-in dialer functionality, call disposition tracking, agent activity monitoring, and related tools.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscription & Billing
Dial Out is offered on a subscription basis. By subscribing, you agree to pay the fees associated with your selected plan. All fees are non-refundable except as required by law or as explicitly stated in these terms.
We reserve the right to change our pricing at any time. If we do, we will provide notice of the change at least 30 days before it takes effect. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or industry requirement (including TCPA, FDCPA, and state insurance regulations)
- Call numbers on the National Do Not Call Registry without proper exemption
- Record calls without complying with applicable consent laws
- Upload or transmit any unlawful, harmful, or fraudulent content
- Interfere with or disrupt the Service or servers connected to the Service
- Attempt to gain unauthorized access to any portion of the Service
6. Call Compliance
You are solely responsible for ensuring that your use of the dialer and call recording features complies with all applicable federal, state, and local laws, including but not limited to the Telephone Consumer Protection Act (TCPA), state call recording consent laws, and insurance marketing regulations. Dial Out provides the tools; you are responsible for using them lawfully.
7. Data Ownership
You retain all rights to the data you upload to the Service, including lead lists, call recordings, and customer information. We claim no ownership over your data. We may use aggregated, anonymized data for analytics and service improvement purposes.
8. Termination
You may cancel your subscription at any time. Upon cancellation, your access to the Service will continue until the end of your current billing period, after which your account may be deactivated. We reserve the right to suspend or terminate your account immediately if we believe you have violated these Terms or engaged in fraudulent or illegal activity.
9. Limitation of Liability
To the maximum extent permitted by law, Dial Out and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
11. Changes to Terms
We may modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the change becoming effective. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.
